How to Book

Terms and Conditions

Your Contract is with Safari India Limited Liability Partnership.

1. Your Contract

When you make a booking you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions. A contract will exist as soon as we issue our confirmation invoice. This contract is made on the terms of these booking conditions, which are governed by English Law, and the jurisdiction of the English courts. If you had not seen these terms and conditions when you made your booking and you are not happy to proceed with the booking now that you have seen them, please return all documentation to us within 7 days of receiving these booking conditions. Your booking will be cancelled and all monies will be returned in full, provided you have not commenced your travel.   This clause does not apply if your booking was made within 8 weeks of travel.

2. Your Financial Protection

The Package Travel, Package Holidays and Package Tours Regulations 1992 require us to provide security for the monies that you pay for the package holidays booked with us and for your repatriation in the event of our insolvency. 

3. Booking and Payment

You will be advised of the price of the holiday that you wish to book before your contract is confirmed. When you make a booking a deposit of 20% of the total holiday cost is required. Any amounts required to be paid by way of deposits will be considered as non-refundable deposits. The balance of the price of your travel arrangements must be paid no later than 8 weeks before your departure date. If you book your holiday 8 weeks or less before departure the full amount will be required. If the balance is not paid in time we shall retain your deposits. Following the issue of our confirmation invoice, surcharges will only be made as a result of subsequent changes to the cost of providing your holiday such as cost of hotels or lodges, fares, entrance fees to monuments or parks and taxes. We will only pass an increase on to you if it is 2% or more of the cost of your holiday.

In the unlikely event that the increase is more than 10% of the price of your travel arrangements, you may cancel your travel arrangements and receive a full refund of all monies paid, except for any premium paid to us for holiday insurance. Should you decide to cancel for this reason, you must exercise your right to do so within 14 days from the issue date printed on your final invoice. Whether you cancel or not you will also be entitled, on the terms set out in respect of major changes in paragraph 7 below, to accept an offer of alternative travel arrangements from us if we are able to do so.  

4. If You Change Your Booking    

If, after the confirmation invoice has been issued, you wish to change your travel arrangements in any way, we will do our utmost to make these changes but it may not always be possible. Any requests for changes to be made must be in writing from the person who made the booking. We will charge a fee of £50 per person plus any additional costs incurred.  

5. If You Cancel Your Holiday  

If you wish to cancel or transfer your booking for any reason other than for there being additional charges (see clause 4) or alterations to arrangements (see clause 7 below) you may do so providing that you give us written notice of cancellation which must be signed by the person who made the booking. Cancellation is effective from the date upon which we receive the written notice. If we receive the notice of cancellation or transfer up to 56 days before the departure date you merely forfeit your deposit. After that date you will additionally be liable for the following cancellation or transfer charges based on the time we receive your written notice:  

a) Between 56 and 42 days before departure date: 30% of the total price of your holiday.  

b) Between 41 and 21 days before departure date: 50% of the total price of your holiday.  

c) Less than 21 days before departure date: 100% of the total price of your holiday.  

In the event of the non-refundable deposits exceeding the amount of any cancellation charge, we are entitled to retain such deposits (clause 4). If the reason for your cancellation is covered under the terms of your insurance policy, you may be able to reclaim these charges. You are advised to ensure that your policy has sufficient financial protection to cover you in the event of cancellation.  

6. If We Change or Cancel Your Holiday  

It is unlikely that we will have to make any changes to your travel arrangements, but these arrangements are usually booked months in advance, and occasionally we have to make changes and we reserve the right to do so at any time. Most of these changes will be minor and we will advise you of them at the earliest possible date. We also reserve the right in any circumstances to cancel your travel arrangements. However, we will not cancel your travel arrangements after the date when the balance of the price becomes due except for reasons of force majeure or failure by you to pay the final balance. If we are unable to provide the booked travel arrangements you can either have a refund of all monies paid or accept an offer of alternative travel arrangements of comparable standard from us if available (we will refund the difference in price if the alternative is of a lower value). If we make a major change to your holiday, we will inform you as soon as reasonably possible if there is time before your departure. You will have the choice of either accepting an offer of alternative travel arrangements of comparable standard from us if available, or cancelling the booked holiday and receiving a full refund of all monies paid.       

In all cases, except where the major change arises due to reasons of force majeure, we will pay compensation as detailed below:  

Less than 14 days before departure £50 per person

Between 15 and 56 days before departure £25 per person  

Or as an alternative we will offer you a 5% reduction in the cost of your next booking with us (excluding the cost of any international flights).  

In any case the limit will be £50 per person or 5% of the cost of your next booking with us.  

Force Majeure: we will not pay compensation if we have to cancel or change your travel arrangements in any way because of unusual or unforeseeable circumstances beyond our control. Force majeure events could include but are not restricted to, war, riot, civil unrest, industrial dispute, terrorist activity and its consequences, natural or industrial disaster, pandemic illness, fire, adverse weather conditions, technical problems to transport, closure or congestion of airports or rail stations, decisions by governments or national park or similar authorities, changes of schedules or operational decisions of air carriers or rail companies.  

7. Minimum Numbers  

It may be necessary for us to set a minimum number of customers on some trips before that trip can be run. If this is the case you will be notified of this at the time of booking. Should any changes be made to the trip as a result of the minimum number not being achieved clause 7 above will apply.  

8. If You Have a Complaint    

If you have a problem during your holiday, please immediately inform our representative who will try address the problem. Should a problem not be resolved satisfactorily, you may call our Emergency Telephone number which will be given to you before your departure. If your complaint is not resolved locally, please follow this up within 28 days of your return home by writing to us at The Rock Cottage, Dolberrow, Churchill, North Somerset, BS25 5NT giving your booking reference and all other relevant information.  

It is strongly suggested that you communicate any complaint to the supplier of the services in question as well as to our representative, and not await your return home before advising Safari India LLP of your complaint. If you fail to follow this simple procedure we will have been deprived of the opportunity to investigate and rectify your complaint whilst you were on tour and this may affect your rights under this contract.       

9. Our Liability to You   

If the contract we have with you is not performed or is improperly performed by our suppliers or us, we will pay you appropriate compensation if this has affected the enjoyment of your travel arrangements. However, we will not be liable where any failure in the performance of the contract is due to:  

a) You, or a third party unconnected with the provision of the travel arrangements; or  

b) Unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised; or  

c) An event which we or our suppliers, even with due care, could not foresee or forestall.  

Our liability, except in cases involving death, injury or illness, shall be limited to a maximum of twice the cost of your travel arrangements.  

10. Official Entry and Health Requirements    

Any advice that we give you with regard to entry or health requirements is given in good faith.  

Passengers must carry passports valid for 6 months from their return date.  

A valid visa is normally required for travel to India, however, it is the personal responsibility of the passenger to make sure his or her passport is valid and contains the necessary visa(s) and travel documents, including medical certificates where required, for his or her journey. As visas are usually valid for only a limited time period, we strongly advise that no visas are obtained prior to eight weeks before your departure date. Holders of passports which are not British should take particular care as visa requirements may differ and it is most important that your passport contains the correct visa for your journey. Safari India LLP does not accept any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements. ( Visa applications )

It is your responsibility to take any necessary health precautions before and during your travel. Health and vaccination advice should be sought from your GP or other travel health expert such as a travel clinic. ( Travel health advice )  

11. Insurance Protection    

We are unable to accept passengers who have not taken out adequate holiday travel insurance protection. If you do not have holiday insurance cover at the time of booking, you may be personally liable for cancellation charges. We will require details of your insurance company, policy number and the emergency contact number of your insurer. If at the time of the start of your holiday you have not provided these details or adequate proof of insurance we reserve the right to refuse you travelling with Safari India LLP and may treat this as a cancellation by you. It is imperative that you familiarise yourself with the details and conditions of your policy and that you notify your insurance company of any pre-existing medical condition.   Failure to do so can invalidate the insurance cover.  

12 . The Nature of our Holidays    

Safari India LLP specialises in holidays to remote or developing areas and on many tours you may be in close proximity to wild animals. You acknowledge the possible dangers of this type of travel. Medical facilities may be limited in some areas and standards of Health and Safety and local regulations are not what we are used to in Western Europe. Inclusion of accommodation or service in our brochure or website does not imply that it has been inspected by us, or that it conforms to any particular set of health and safety standards. You travel at your own risk, and Safari India LLP is not to be held responsible for any accident to you or your property, unless shown to be as result of our negligence.  

You must be prepared to be flexible as delays and unexpected cancellations can and do happen meaning loss of time and changes of plan. Suppliers may withdraw facilities we have advertised without giving us advance notice. We cannot be held responsible for such situations, nor are we liable for refunds. This is part of this type of holiday and the itinerary should be viewed as an indication of what we aim to accomplish rather than as a contractual obligation.  

13.   Children and Infants   

We do not recommend our trips as being suitable for infants or children under the age of 14 years at the date of travel. We retain the right to refuse bookings for any of our group trips for any child under the age of 16 at the date of travel, unless the trip is booked totally by customers known to each other. The risks of taking children on any trip are entirely at the responsibility of the adults accompanying them.

14.   Behaviour

During the trip you must abide by the laws of the country being visited and respect local customs. If you commit any illegal act, behave offensively, are under the influence of alcohol or illegal drugs, or act in any way that is detrimental to the safety or welfare of other group members, your guide, local people, other travellers, wildlife or the environment your guide has full authority to ask you to leave the trip at any stage. In such circumstances we will not be liable to you and no refund will be given.

15. Joining the Trip

We will notify you of the departure point and departure time of the trip. You are responsible for ensuring that you arrive at the departure point at the correct time. You will be met at the departure point by our representative.
